By accessing our website or booking any of our curated travel experiences (“Services”), you agree to comply with these Terms & Conditions (“Terms”). These terms are designed not just to protect both parties, but to uphold the spirit, exclusivity, and integrity of every Madcap Luxe journey.

1. Eligibility

Madcap Luxe journeys are designed for discerning travellers above 18 years of age who are legally competent to enter into binding contracts under the Indian Contract Act, 1872. By proceeding with a booking, you confirm that all details provided are accurate and authentic.

2. Our Services

Madcap Luxe curates rare self-drive expeditions, luxury convoys, and bespoke adventure experiences across India and the world.
Each experience is crafted, not mass-produced — and is subject to availability, custom curation, and specific inclusions as described on our website, brochures, or official communication channels.

We reserve the right to modify itineraries or inclusions to enhance safety, comfort, or experience quality, without prior notice if required due to weather, operational, or regulatory reasons.

3. Bookings & Payments

• All bookings are confirmed only upon receipt of the required advance payment as communicated in your expedition or experience proposal.
• Prices are dynamic and may vary due to exchange rate fluctuations, fuel prices, government regulations, or other economic conditions.
• Any customizations, add-ons, or bespoke inclusions requested by guests may incur additional charges, disclosed transparently before payment.
• Final invoices, confirmation documents, and expedition details will be shared upon completion of the payment process.

4. Cancellation, Refunds & Transfer Policy

Each Madcap Luxe journey is an exclusive, limited-seat experience. We value your commitment and, in turn, ensure fairness and clarity in our policies.

Cancellations received:

• More than 60 days before departure: 90% refund of the total amount.
• 30–60 days before departure: 75% refund.
• 15–30 days before departure: 50% refund.
• 7–15 days before departure: 20% refund.
• Within 7 days of departure or no-shows: No refund.

Additional Notes:

• Any costs related to visas, flights, third-party experiences, or insurance are non-refundable.
• Refunds, where applicable, will be processed within 14 working days to the original payment method.
• In select cases, transfer of participation to another eligible guest may be permitted (subject to approval and logistical feasibility).
• In the unlikely event of cancellation by Madcap Luxe (e.g., due to force majeure, safety issues, or government restrictions), a full refund or credit note for a future journey will be provided.

5. Guest Conduct & Responsibility

Madcap Luxe journeys are crafted for a small, select group of explorers. To maintain the ethos of our experiences, we expect all participants to:

• Provide complete and accurate information during booking.
• Follow instructions from the expedition leads, local partners, and convoy managers for safety and operational coordination.
• Respect local cultures, communities, and environmental practices.
• Take responsibility for any intentional or negligent damage to third-party property or vehicles.

Unruly, illegal, or unsafe behavior may lead to immediate removal from the expedition, without refund.

6. Liability & Risks

Adventure, by nature, carries inherent risks — from weather changes to terrain challenges. Each guest joins a Madcap Luxe journey at their own discretion and risk.

Madcap Luxe acts as the principal organizer and curator, engaging third-party partners (transport, accommodation, activities, guides) in good faith.
We are not liable for injuries, delays, losses, or damages caused by third parties, natural calamities, force majeure events, or acts beyond our control.

Guests are strongly advised to obtain comprehensive travel and medical insurance covering high-altitude, adventure, and self-drive activities.

7. Privacy & Communication

We value your trust and discretion. Personal information shared with us is used solely for operational, logistical, or emergency purposes and is never sold or shared with unauthorized entities.

By engaging with us, you consent to receive essential updates and transactional communication related to your booking via email, WhatsApp, SMS, or phone.

8. Intellectual Property

All content on the Madcap Luxe website — including imagery, text, videos, brand elements, and design — is owned by Madcap Adventure Pvt. Ltd. and protected under applicable intellectual property laws.
No part of the website or communication material may be reproduced, distributed, or used for commercial purposes without prior written consent.

9. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India.
Any disputes arising from these Terms shall fall under the exclusive jurisdiction of the courts of New Delhi, India.

By making a booking, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
Every Madcap Luxe journey represents a shared understanding — that true adventure is built on trust, respect, and the pursuit of experiences money alone cannot buy.
